JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-06-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 387, 506, 34 of the Indian Penal Code.
The prosecution case is that the petitioner and co-accused Raj Kumar Dubey obstructed the work done for the drainage of certain soil area and demanded Rs. 50,000/- as extortion. When the informant failed to stop the work then he was being assaulted. The police arrested co-accused Raj Kumar Dubey but the petitioner escaped from the scene. It is submitted by learned counsel for the petitioner that brother of co-accused Raj Kumar Dubey lodged Raghunathpur P.S. Case No. 20 of 2016 levelling accusation under Sections 147, 148, 149, 323, 324, 427/504 of the Indian Penal Code against the informant and the F.I.R attesting witness Digambar Dubey on 21.01.2016 and after about two
Patna High Court Cr.Misc. No.25653 of 2016 (2) dt.29-06-2016 2/2 months the present case has been lodged. It is further submitted that there is land dispute between the parties for which under Section 107 and 144 Cr.P.C proceeding were initiated. Moreover the accusation is omnibus and general against the petitioner.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IV, Siwan in connection with Raghunath Pur P.S. Case No. 49 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
