JUSTICE ARVIND SRIVASTAVA ORAL ORDER 16-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Musahri P.S. Case No. 02 of 2017 registered under Sections 406 and 420 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the Annexures 3 to 8 that petitioner is agent of the Registered Company. She received money and deposited the same in the company and Company issued bond papers to the investors. In the meantime, SEBI imposed certain restrictions on functioning of the company and thereafter, a Committee was constituted by the Hon'ble Supreme

Patna High Court Cr.Misc. No.12664 of 2017 (4) dt.16-05-2017 2/2 Court and directed the Committee to sale the properties of the company so that the payments should be made to the investors after auctioning the assents and properties. Further submission is that petitioner is innocent and she has no criminal antecedent. Hence, she deserves bail.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Muzaffarpur in connection with Musahri P.S. Case No. 02 of 2017 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
