JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-10-2018 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case under Sections 341, 323, 504, 506 and 304(B)/34 of the Indian Penal Code. Allegation against the petitioner is of demand of dowry and also assault on the deceased. The petitioner happens to be husband of the deceased.

It has been submitted on behalf of the petitioner that the deceased was ill and due to that during course of treatment the deceased at A.N.M.C.H., Gaya. The petitioner is in custody since 16.07.2018. The father-in-law and mother-in-law of the deceased have been granted anticipatory bail vide order dated 17.02.2018 passed in Cr. Misc. No.2932 of 2018 by another co-ordinate Bench of this Court.

Patna High Court Cr.Misc. No.54877 of 2018 (3) dt.09-10-2018 2/2 Heard learned APP appearing for the State.

In view of the fact that there is specific allegation of demand of dowry and assault to the deceased against the petitioner, I am not inclined to enlarge the petitioner on bail at this stage. Accordingly, the same is dismissed in connection with Kinjar P.S. Case No.79 of 2017, pending in the court of learned S.D.J.M., Arwal.
