JUSTICE SANJAY PRIYA ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Agam Kuan P.S. Case No. 41 of 2017 instituted for the offence under sections 30(a) of the Bihar Excise Prohibition Act.
It is alleged that foreign liquor has been recovered from the house of Inderadeo Prasad. He told the raiding party that his son (Petitioner) used to bring liquor from Jharkhand and sales the same on higher prices.
He has further stated that at present he has gone to Jharkhand to bring liquor.
In this manner, the name of this petitioner has been disclosed by his own father that he used to bring liquor from Jharkhand.
Patna High Court Cr.Misc. No.14492 of 2017 (2) dt.28-03-2017 2/2 Under such circumstances, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail of the petitioner is rejected The petitioner is directed to surrender before the court below and pray for regular bail which shall be considered and disposed off on its own merit without being prejudiced by this order.
