JUSTICE SUDHIR SINGH ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 420,406, 468, 272, 273 of the Indian Penal Code and 47(A) Excise Act.

The allegation against the petitioner is that 182 litres of illicit liquor was recovered from the house of the petitioner. It is submitted on behalf of the petitioner that the petitioner is in custody since 05.04.2016.The petitioner has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. The seizure list does not bear the signature of the petitioner. There is no compliance of Section 100 Cr.P.C. Petitioner was not present at the place of occurrence.

Patna High Court Cr.Misc. No.26177 of 2016 (3) dt.23-08-2016 2/2 On behalf of the State it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., XIV,Bhojpur in connection with Sahpur P.S.Case No.265 of 2015.
