JUSTICE SANJEEV PRAKASH SHARMA ORAL JUDGMENT Date : 24-04-2023 Learned counsel for the petitioner submits that the petitioner had filed a writ petition before this Court wherein this Court directed the respondents to initiate appropriate proceedings against the petitioner under the Bihar Targeted Public Distribution System Control Order, 2016 and take a decision within the stipulated period of 180 days.

2. Learned counsel further submits that despite the order passed by the Division Bench, the respondents have not taken a decision within the stipulated period of 180 days. He has, therefore, filed the present petition

3. In the opinion of this Court, a fresh writ petition

Patna High Court CWJC No.15152 of 2022 dt.24-04-2023 2/2 for the same cause of action would not arise. If the compliance has not been made of the order passed by the Division Bench, the remedy lies else where.

The writ petition is wholly misconceived and is, accordingly, dismissed.
