ANJANA MISHRA ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 406/409/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that though originally the final form was submitted showing the case as against the petitioner to be a mistake of fact, subsequently, the magistrate has differed and has taken cognizance of the offence. It is further submitted that actually no fraud has been perpetuated and the amount of funds alleged to have been misappropriated, have been, in fact, utilized for the purpose of purchasing bricks by the Panchayat Sewak.
Patna High Court Cr.Misc. No.27790 of 2016 (2) dt.17-09-2016 P2/2 Considering the aforementioned facts and circumstances and that there is no further cogent material against the petitioner, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Gaunaha P.S. Case No. 45/2010, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
