JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 11.1.2018 passed in Cr.Misc.No. 61877 of 2017 with an observation to conclude the trial within a period of six months.

Submission of learned counsel for the petitioner is that petitioner is in custody since 28.5.2014 and trial has not been concluded as yet.

Heard learned APP also and perused the report from which it appears that trial is pending only for evidence of Doctor and trial will be concluded within three months. In the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage.

No.55064 of 2018 (3) dt.26-09-2018 2/2 However, learned trial court is directed to expedite the trial and try to conclude it within a period of three months from the receipt of this order. However, if trial is not concluded within the said period, petitioner shall be released on bail by trial court to its own satisfaction.

With the above observation, this application is disposed of.
