JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-08-2019 This is an application for grant of anticipatory bail in connection with Kudra P.S. Case No. 419 of 2018 disclosing offences under Sections 341, 323, 307, 324, 34 of IPC. Prosecution case is that petitioners and seven other accused persons assaulted the informant by lathi and danda, causing injury.
Submission of the learned counsel for the petitioners is that there is a case and counter case between the parties. Though there is allegation against ten accused persons of assault by lathi and danda and only three injuries were found on the person of the informant and out of which, the opinion of the
Patna High Court CR. MISC. No.53543 of 2019(2) dt.27-08-2019 2/2 Doctor was kept reserved with respect to one injury and rest injuries are simple in nature.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M., Kaimur at Bhabua, in connection with Kudra P.S. Case No. 419 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U t
