JUSTICE SHAILENDRA SINGH ORAL ORDER 30-08-2025 Heard Mr. Diwakar Prasad Singh, learned counsel for the Petitioners, Mr. Pawan Kumar Singh, learned counsel for the informant and Mr. Nand Kumar, learned APP for the State.

2. Petitioners seek regular bail in connection with Bihta P.S. Case No. 648 of 2022 dated 05.07.2022 registered for the offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.

3. The main submissions advanced by petitioners' counsel are that the petitioners and the informant/complainant are own brothers and in between them, there is partition dispute that took place in the lifetime of petitioners' father and the disputes raised by the informant/complainant is completely of

No.59802 of 2025(2) dt.30-08-2025 2/3 civil nature regarding which initially respective Mutation Appeals were filed by both the parties which were disposed of and thereafter, being aggrieved by the order passed by Deputy Collector Land Reforms, the petitioners have preferred an appeal before the Additional Collector which is still pending.

4. On the other hand, learned counsel appearing for the informant/complainant has submitted that the petitioners succeeded in creating a false Jamabandi in their names by using false and forged documents before the Circle Officer, Bihta, Patna and they also used false and forged Partition Deed by making false signature and false seal of Notary Public, Patna.

5. Learned APP appearing for the State has also opposed the prayer for bail of the petitioners.

6. Considering the facts and circumstances of this case and mainly the nature of allegation and also the fact that in between both the parties, who are close relatives, there is partition dispute and the documents which have been alleged by the complainant as being forged, were executed several years ago and in between both the parties there is civil litigation also, in my opinion, it is a fit case for bail to the petitioners. Accordingly, let the petitioners named-above be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty
