The petitioner who is in custody, seeks bail in connection with Patliputra P.S. Case No. 40 of 2018 registered for the offence punishable under Section 364(A) of the Indian Penal Code.
Informant has alleged that his brother has been kidnapped while going to school by unknown criminals and demanded ransom of 1.5 crores from him.
Kidnapped boy was recovered by the police from the tenanted premises of petitioner who had taken said premises on rent from Sudhir Kumar and the kidnapped boy was kept in the room whose hands and feet were tied by iron chain. Petitioner was arrested from the room where kidnapped boy was kept and from said room police recovered logo and sticker of police on fake vehicle number plate. Petitioner is one of the prime
Patna High Court Cr.Misc. No.54757 of 2018(4) dt.06-10-2018 2/2 accused involved in kidnapping of the boy.
Considering the nature of allegation and incriminating materials found against him during investigation, I am not inclined to grant bail to the petitioner. Accordingly the prayer for bail is rejected.
