JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-06-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Suiya P.S. Case No. 88 of 2017 for offences under Sections 341, 323, 427, 498(A) and 506/34 498A of the Indian Penal Code.

In the instant case, by order dated 20.11.2019 the matter was sent to the Patna High Court Mediation Centre for amicable settlement of the dispute between the petitioner and opposite party no. 2 and the Mediation Centre submitted a report dated 05.02.2020 which shows that the dispute between the parties could not be resolved.

Patna High Court CR. MISC. No.56885 of 2019(6) dt.12-06-2020 2/2 Learned counsel for the petitioner would submit that opposite party no. 2 did not turn up in the Mediation Centre. Considering the aforesaid, this Court is inclined to grant bail to the petitioner. Let petitioner, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate1, Banka in connection with Suiya P.S. Case No. 88 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

After release of the petitioner, the matter may be referred to the District Mediation Centre and the petitioner and opposite party no.2 will appear before the Mediation Centre so that the dispute may be amicably settled between the husband and wife.
