The petitioners apprehend their arrest in Barhara P.S. Case No. 52/2016, registered for the offences punishable under Sections 304B, 120B and 34 of the Indian Penal Code. The informant alleged that his daughter was married with Luv Kumar Sah, but her father-in-law and mother-in-law were demanding additional dowry. His daughter came to his house, but on 04.03.2016 his son-in-law Luv Kumar Sah also came to his house and slept with his daughter and in the next morning the dead body of his daughter was found. She was strangulated to death.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.8993 of 2017 (3) dt.08-03-2017 2/2 daughter of the informant died in the house of the informant. The petitioners were not even present there. The informant made specific allegation against the husband of the deceased that the husband strangulated her to death and fled away from the house. The husband has already been granted regular bail by Hon'ble the Chief Justice vide order passed in Cr. Misc. No. 44610/2016.
Considering the facts aforesaid and the fact that the petitioners are father-in-law and mother-in-law of the deceased and the deceased died in her Naihar, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Purnea in connection with Barhara P.S. Case No. 52/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
