Petitioner prays for bail in connection with Pasraha P.S..Case No. 87 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code.
Allegation against the accused persons, including the petitioner is that they have intercepted motorcycle of the informant and snatched away Rs.2,20,000/- from the bag along with mobile phone. Petitioner is named in the FIR. Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case at the instance of one Jenain Kumar, who has political rivalry to the petitioner. Further submission is that though it is alleged that after collection of money from Jenain Kumar the informant was going towards his house but the said Jenain Kumar has not been
Patna High Court Cr.Misc. No.56452 of 2018(3) dt.01-11-2018 2/2 examined during investigation and furthermore petitioner is a resident of another village and he has enmity with Jenain Kumar in connection with Gram Panchayat election and he is in custody since 24.7.2018, having no criminal antecedent. Heard learned APP also.
Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. Accordingly, this application is dismissed.
