The petitioners apprehend their arrest in a case registered for the offence under Sections 147, 148, 149, 302 of the Indian Penal Code.
As per the prosecution case, on 12.06.2021, all the F.I.R. named accused persons including these petitioners variously armed with deadly weapons assaulted the father of the informant, as a result of which, he died.
It is submitted on behalf of petitioners that though, there is allegation that petitioners and others have assaulted the deceased with deadly weapons, but as per post-mortem report, only one injury of abrasion has been found on the person of
Patna High Court CR. MISC. No.68120 of 2021(3) dt.12-07-2022 2/2 deceased. Petitioners have clean antecedent.
However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that petitioners are named in the F.I.R. and informant claims to be eye-witness of the occurrence.
Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioners is rejected. (Prabhat Kumar Singh, J) anay/- U T
