JUSTICE SANJAY PRIYA ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Barachatti P.S. Case No. 378 of 2016 instituted for the offence under sections 272, 273, 120B of the Indian Penal Code and Section 47A, 48(2), 54 63 of Bihar Excise Amendment Act. It has been submitted that total 72 liters of foreign liquor has been recovered from a Scorpio car and seizure list was prepared. Total four persons were apprehended sitting on the car. The car admittedly belongs to this petitioner. In such circumstances, there is huge recovery of foreign liquor from the car belonging to the petitioner, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is

The petitioner may surrender before the court below and make prayer for regular bail which will be considered in accordance with law keeping in view that this petitioner is not apprehended on the spot.
