The petitioner apprehends his arrest in connection with Saharsa Mahila P.S. Case No. 28 of 2022 registered under Sections 341, 498A, 379, 504, 506, 323/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Learned counsel appearing on behalf of the petitioner submits that from perusal of the report of the Mediator dated 31.01.2023, it is apparent that the disputes between both the parties have already been resolved through the process of
Patna High Court CR. MISC. No.60403 of 2022(3) dt.07-02-2023 2/2 mediation. Petitioner and his wife-opposite party no. 2 are ready to lead their conjugal live peacefully in the light of the Memorandum of the Agreement dated 31.01.2023 at Flag- "O". Having considered the above facts and circumstances of the case as well as the report of the mediator, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of S.D.J.M., Saharsa in connection with Saharsa Mahila P.S. Case No. 28 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
