JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 131, 132 and 135(A) of the Representation of People Act and Sections 393 and 354/34 of the Indian Penal Code.

Petitioner and two others were caught on the spot when allegedly, 50 persons having entered into the polling booth created nuisance.

Submission on behalf of the petitioner is that having similar allegation, two other co-accused have already been allowed privilege of bail.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.25809 of 2016 (2) dt.22-06-2016 2/2 the case as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Munger in connection with Asarganj P.S. Case No. 30 of 2016.
