2. The petitioner is apprehending his arrest in connection with Madhubani Complaint Case No. 886 of 2023 for the offence under Sections 498A, 323, 540, 379 of the I.P.C.

3. As per the prosecution story, complainant - Yashfeen Afaza is wife of the petitioner - Saadat Hussain and her marriage was solemnized on 29.07.2021 as per Muslim rites. After some time of the marriage matrimonial dispute arose between them due to non-fulfillment of the dowry demand and as a result she was abused and assaulted.

4. Learned counsel for the petitioner submits petitioner is innocent and has committed no offence, he has

5. Learned APP opposes the prayer of anticipatory bail.

6. During course of argument learned counsel for complainant submits that the petitioner has also filed a case before the Principal Judge, Family Court, Madhubani vide M. M. case No. 81 of 2024 for restitution of conjugal life. This fact goes in favour of the petitioner.

7. Keeping in view the aforesaid facts this Court is inclined to enlarge the petitioner on anticipatory bail.

8. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned C.J.M., Madhubani in connection with Complaint Case No. 886 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (S. B. Pd. Singh, J) prabhakar/- U T
