Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

The prosecution case is that 90 litres country made liquor and 7.2 litres English liquor were recovered from the house of one Lalbabu Prasad and his confessional statement, name of the petitioner surfaced.

Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.67836 of 2021(2) dt.07-06-2022 2/2 there is no recovery from the possession of the petitioner and he has stated at para 3 of the bail petition that the petitioner has clean antecedent.

Learned A.P.P. for the State has opposed the bail petition of the petitioners and submits that the name of the petitioner sprung up on the statement of co-accused Lalbabu Prasad.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge cum Special Judge Excise Bhojpur at Ara in connection with Koilwar P.S. Case No. 282 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
