JUSTICE BIRENDRA KUMAR ORAL ORDER 03-03-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 47 of the Bihar Excise (Amendment) Act, 2016 and Sections 2(e)/3/5(b)/18 of the Mahua Flowers Act.
Mahua was recovered from a magic vehicle on 09.09.2016.
Petitioner has stated on oath that he has got no criminal antecedent.
Considering the aforesaid fact, let the petitioners, above named, in the event of their arrest or surrender before the
Patna High Court Cr.Misc. No.5219 of 2017 (2) dt.03-03-2017 2/2 Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Munger/Successor Court in connection with Kharagpur Police Station Case No.157 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
