JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-03-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 341, 326, 307, 506, 504 and 379/34 of the Indian Penal Code.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that F.I.R. itself shows that no specific allegation is there against the petitioner. Only allegation against the petitioner is that he caught the informant and other co-accused has cut the tongue of the informant.
Heard learned A.P.P. as well as learned counsel for the informant. Learned counsel for the informant submits that F.I.R. itself shows that petitioner assisted the other co-accused in cutting the tongue of the informant.
Patna High Court Cr.Misc. No.8491 of 2017 (2) dt.01-03-2017 2/2 Considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected.
However, petitioner is directed to surrender in the court below, i.e., learned Judicial Magistrate-Ist Class, Danapur, Patna, in connection with Maner P. S. Case no. 453 of 2016 and make prayer for regular bail which will be considered on the basis of the allegation levelled in the F.I.R. without being prejudiced by the order of this Court.
