JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The Petitioners seek regular bail in connection with Jamo Bazar P.S.Case No. 92 of 2017, registered for offences punishable under Sections 304B/201/120Bof the Indian Penal code.

As per F.I.R., allegation against the petitioners, who happens to be the father-in-law and husband of the deceased and other accused is that they burnt the deceased due to non fulfillment of demand of dowry.

Submission of the learned counsel for the petitioners is that the petitioners have been falsely implicated in this case and as per F.I.R. the deceased died due to diarrhea and while she was taking away to hospital she died and without any information the dead body of the deceased was disposed of and the petitioners are

Patna High Court Cr.Misc. No.56141 of 2018 (3) dt.08-10-2018 2/2 in custody since 06.07.2018 and charge sheet has been submitted against the petitioners.

Heard learned A.P.P also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner No. 2, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- XIII, Siwan in connection with Jamo Bazar P.S.Case No. 92 of 2017, subject to the following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. ii) The petitioner will not induce any witness or tamper with the evidence.

So far the petitioner No. 1 is concerned, it is also submitted that the petitioner No. 1 has already been granted anticipatory bail by this Court vide order dated 19.07.2018, passed in Cr. Misc. No. 42125 of 2018.
