Petitioners are apprehending their arrest in connection with Halsi PS Case No. 90 of 2018 for the offence under Sections 147, 341, 323, 307, 354, 504 and 506 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. In the instant case, from the FIR it would be evident that the petitioners are only the members of the mob. There is no allegation of overt act by the petitioners.
Considering the aforesaid, the petitioners above
Patna High Court Cr.Misc. No.62468 of 2018(3) dt.12-12-2018 2/2 named, in the event of arrest or surrender before the court below within one month from today, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Lakhisarai in connection with Halsi PS Case No. 90/2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
