2. Petitioner apprehends arrest in a case registered for the offence punishable under section 420 and 504 of IPC . 3 . As per the prosecution case, complainant, namely Arvind Kumar, alleged that this petitioner transferred his land in favour of one Bhagwat Prajapati, who had transferred the same land in favour of the complainant in the year 2008, but again this petitioner, having knowledge of his earlier alienation, fraudulently transferred the same land to other person to take huge consideration money and thus, cheated the complainant. When complainant asked this petitioner regarding the aforesaid

Patna High Court CR. MISC. No.61684 of 2025(2) dt.09-09-2025 2/2 occurrence , then petitioner abused complainant. Accordingly , the present complaint was lodged.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence as alleged. Petitioner has got no concern with the aforesaid occurrence . The dispute involved in this case is purely civil in nature . Petitioner claims clean antecedent.

Learned counsel for the State opposed the prayer for bail and submitted that there is a specific allegation against this petitioner that he transferred the land of the complainant to other person with the intention to earn huge money, despite knowing the fact that the land in question is in peaceful possession of the complainant, and thus, he created trouble and loss to the complainant. Witnesses have also supported the prosecution case .

6. Considering the nature of accusation and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
