In this case, the petitioner is seeking anticipatory bail in connection with Barhara (Krishnagarh) P.S. Case No.155 of 2016, registered for the offence punishable under Sections 420, 467, 468, 471 and 120-B of the Indian Penal Code. As per the allegation, the petitioner entered into the service of Panchayat Teacher on the basis of fake certificate. The Government has taken lenient view, granted time to those who have entered into the service through fake and fabricated certificates may tender resignation from the post, on that account, no criminal case will be lodged, in failure the person will have to face the consequences. In pursuance thereof, the present case has
Patna High Court Cr.Misc. No.26677 of 2016 (3) dt.04-07-2016 2/2 been lodged against the petitioner as she did not tender resignation.
Learned counsel for the petitioner submits that the petitioner is ready to return the amount received by him along with 6% interest.
On the statement at bar, if the petitioner deposits the said amount within a period of 15 days from today, the petitioner would be released on bail in the event of arrest or surrender within four weeks from today on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, in connection with Barhara (Krishnagarh) P.S. Case No.155 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
In failure to deposit the said amount, this order will be treated to have been withdrawn.
