====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Kursakanta P. S. Case No. 51/2024 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 133.50 liters illicit liquor was recovered from an open place.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner is in custody since 07.05.2025 and claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposes the

Patna High Court CR. MISC. No.57468 of 2025(2) dt.17-10-2025 2/2 bail application.

6. Considering the nature of accusation, period of custody and clean antecedent, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise Court-II, Araria in connection with Kursakanta P. S. Case No. 51 of 2024.
