JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 03-05-2017 Heard the learned counsel for the petitioner, the learned A.P.P. for the State as also the learned counsel for the Informant.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Kochas (Parasathua) P.S. Case No. 158 of 2016 for the offences punishable under sections 147, 148, 149, 341, 323 and 307 of the I.P.C and section 27 of the Arms Act.
Allegedly, in the occurrence the petitioner opened fire with the rifle with an intention to kill but when the cartridge was finished he assaulted Panna Lal Sah with butt of the rifle on his head causing head injury to him. The petitioner assaulted at two

Submission is of false implication and that during investigation the informant in his further statement has not stated the name of the petitioner and further Umesh Chandra Gupta @ Panna Lal vide paragraph-5 of the case diary has specifically stated that Pappu Sah assaulted him with butt of his rifle on his head causing rapture of the head and bleeding, Dular Chandra Sah was assaulted by all, the injury on Umesh Chandra Gupta is simple in nature caused by the hard and blunt substance and as such the petitioner deserves sympathetic consideration. The learned A.P.P. duly assisted by the learned counsel for the informant opposes prayer for pre-arrest bail of the petitioner by submitting that the petitioner has got criminal antecedent as earlier he was involved in the case under section 302 of the I.P.
C and after bail he has committed again this crime.
Patna High Court Cr.Misc. No.11334 of 2017 (3) dt.03-05-2017 3/3 shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M-I, Rohtas at Sasaram in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
