JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323 and 307/34 of the Indian Penal Code.
It is alleged that the petitioner nos. 1 and 2 assaulted Upendra Yadav and Raju Yadav with farsa.
It is submitted by learned counsel for the petitioners that the injuries of Upendra Yadav and Raju Yadav have been found to be caused by hard and blunt substance whereas petitioners alleged to have assaulted with sharp cutting weapon like farsa, though, the injury has been found to be simple in nature. There is no specific accusation of assault levelled against petitioner no.3. Petitioners' side also lodged a case against the
Patna High Court Cr.Misc. No.21793 of 2015 (2) dt.21-05-2015 2/2 informant's side at earlier point of time.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhepura in connection with Shankarpur P.S. Case No. 43 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
