The petitioner seeks pre-arrest bail in connection with Sachiwalaya P.S. Case No. 10 of 2017 (G.R. Case No. 797 of 2017) for the offences alleged under Sections 279, 337, 427 and 34 of the Indian Penal Code and 30(A), 37(B) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that the informant, Sunny Rai, along with Raju Kumar, was returning their house boarding on motorcycle and when reached at Bhikhan Thakur bridge, then, one TATA Indigo car came from wrong side and dashed the motorcycle due to which he and Raju Kumar fell down from motorcycle and sustained injury and motorcycle was also damaged. The said car at that time also dashed a thela. At that time, several persons came there and driver of the car was apprehended, who disclosed his name Mithilesh Kumar Yadav, who was in drunken state. On search of his car, four bottles of liquor were recovered. Mithilesh Kumar Yadav disclosed the

The submission of the learned counsel for the petitioner is that neither petitioner was apprehended on spot nor the petitioner has concerned with the seized vehicle, from which the bottles of liquor were recovered. Petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Sachiwalaya P.S. Case No. 10 of 2017 (G.R. Case No. 797 of 2017) shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Patna, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
