2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 318(4), 61(2), 3(5) of the Bharatiya Nyaya Sanhita and under Sections 8 (c) 20(B), (ii)A of the N.D.P.S Act.

3. As per the prosecution case, the allegation against the petitioner is of concealing the contraband (945 gm ganja) in the vehicle and subsequently creating a circulating incriminating photographic evidence of the

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner was neither the driver nor the owner of the vehicle and has got no relation with the recovered contraband. The only allegation against the petitioner is that it is alleged that this petitioner has planted the contraband and sent photographs to co-accused Amresh Kumar who in turn informed the informant about the transportation of contraband.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the backdrop of the case, nature of accusation and other circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Exclusive
