2. The petitioner apprehends her arrest in connection with Saharghat P.S. Case No. 150 of 2022 registered under Sections 409, 420 and 34 of the Indian Penal Code.

3. As per F.I.R., in spite of allocation of fund, though the work was completed, but there was no regular supply of the water in the ward. At the relevant time, petitioner was Ward Member of Ward No.13.

4. Learned counsel appearing on behalf of the petitioner submits that regular supply of water is the responsibility of the present office bearers and petitioner cannot be held responsible for the same. Moreover, petitioner has already completed the

Patna High Court CR. MISC. No.62783 of 2024(2) dt.27-09-2024 2/2 work of Nal Jal Yojana and to this effect concerned authority has also submitted its report dated 24.5.2022. Similarly situated co-accused persons have already been granted bail by this Court vide order dated 23.06.2023 passed in Cr. Misc. No. 16688 of 2023. Petitioner is a lady and has got clean antecedent.

5. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and similarly situated co-accused persons have already been granted bail, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-I, Benipatti, Madhubani in connection with Saharghat P.S. Case No. 150 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
