The petitioner apprehends his arrest in connection with Balthar P. S. Case No. 72 of 2016 instituted under Sections 363, 365 and 366/34 of the Indian Penal Code. The allegation, in brief, is that the daughter of the informant went to the house of his neighbour and thereafter she did not return and it is suspected that this petitioner along with others had kidnapped her.

Learned counsel for the petitioner submits that the daughter of the informant was major and she was having love affairs with one Ranjan Kumar and she voluntarily eloped and went to Gujarat as it appears from her statement recorded under Section 164 of the Cr.P.C., she appears as consenting party and

Having considered the aforesaid facts and circumstances, let the petitioner, namely, Ritesh Kumar, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Balthar P.S.Case No. 72 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
