JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 09.07.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Bochaha P. S. case no. 338/2013 registered under section 307 and other minor sections of the IPC and 3/ 4 of the Explosive Substance Act.

No doubt, petitioners are named in the first information report with allegation of throwing bomb and making indiscriminate firings but admittedly, not a single person is said to have received any injury. Moreover, it would

S. case no. 332/2013 which has been lodged by the petitioners' side two days prior to the alleged occurrence against the informant of the present case that there was land dispute between the parties. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the petitioners do not have any criminal antecedent, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Smt. Divya Bashistha, Judicial Magistrate, Ist Class, Muzaffarpur/concerned court in Bochaha P. S. case no. 338/2013 subject to condition as laid down under section 438(2) of the Cr.P.C.
