====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 21-09-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Banmankhi P.S. Case No. 333 of 2023 dated 14.07.2023 registered for the offence punishable under Section 392 of the I.P.C.

3. As per the prosecution case, the informant is the Field Officer of 'Chetan India Fin Credit Private Limited,' Banmankhi. On 14.07.2023 at about 3.40 hours, three unknown miscreants snatched cash of Rs. 2,49,210/-, Mobile with SIM bearing No. 6201087272, Aadhar Chard, Pan Card, Company ID Card, Diary etc., from him at Mohniya East Tola on the point of firearm, while he was coming to his office at Banmankhi

Patna High Court CR. MISC. No.65224 of 2024(2) dt.21-09-2024 2/3 after collecting the amount from the different customers of the Company on his Motorcycle bearing Registration No. BR43X/2536.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner is not named in the F.I.R. His name has surfaced in the present case on the basis of the confessional statement of Guddu Kumar who is also the informant of the present case. The said Guddu Kumar has already been granted bail by another Co-ordinate Bench of this Court vide Cr. Misc. No. 72919 of 2023 under order dated 22.11.2023, annexed as Annexure-3 to the present bail application. It is further submitted that the money in question which was recovered from the house of the petitioner is not the looted money. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 09.06.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond

Patna High Court CR. MISC. No.65224 of 2024(2) dt.21-09-2024 3/3 of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Purnea in connection with Banmankhi P.S. Case No. 333 of 2023 with further condition:- (I) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.

7. The application stands allowed.
