The petitioners seek bail in Bibhutipur P.S. Case No. 162 of 2018 instituted for the offence under Section 414 of Indian Penal Code.
Counsel for the petitioners submits that petitioners are in custody since 9.6.2018. They have no criminal antecedent. Counsel for the petitioner further submits that no First Information Report has been lodged against co-accused Jamun Sah with regard to stolen Motorcycle.
It is alleged in the written report that police intercepted the petitioners with Motorcycle, but they could not produce paper of Motorcycle on demand.
Patna High Court Cr.Misc. No.55730 of 2018 (3) dt.08-10-2018 2/2 It is mentioned in the impugned order that during course of investigation police found seized Motorcycle standing in the name of Jamun Sah as mentioned in paragraph-30 of the case diary.
Petitioner is in custody since 9.6.2018.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Rosera, Distt. Samastipur, in connection with Bibhutipur P.S. Case No. 162 of 2018, subject to the condition that both the bailors will be close relatives of the petitioners.
