JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code.

Petitioner and five others are named in the first information report on the accusation that they assaulted the informant and others as a result of which informant and others sustained injury and maternal grand mother of the informant died in course of her treatment.

Submission on behalf of the petitioner is that no specific overt-act has been attributed against the petitioner rather general allegation of assault has been levelled against all the

Patna High Court Cr.Misc. No.27532 of 2016 (3) dt.16-09-2016 2/2 accused and having similar allegation, co-accused, Naval Kishore Sah has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 19.08.2015 passed in Cr. Misc. No. 33314 of 2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, (West) Muzaffarpur in connection with Paroo P.S. Case No. 122 of 2014.
