The petitioners apprehend their arrest in Surypura P.S. Case No. 01/2017, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. Jitendra Singh the informant named the petitioners and others and alleged that Bahadur Singh assaulted Tetari Devi with Farsa causing cut injury on her cheek. Ram Pravesh Singh petitioner no. 1 is alleged to have assaulted Birendra Singh and Bhaiya Ram Singh brother and father of the informant. Patna High Court Cr.Misc. No.15270 of 2017 (2) dt.18-04-2017 2/3 snatched Rs. 30,000/- from the pocket of the informant. No specific allegation of assault is made against the petitioners. Learned counsel for the petitioners submits that there is counter version. Even of course the case from the side of the petitioner was lodged on the next day, but on account of land dispute both the parties entered into scuffle. The petitioners are not the assailant. Only Tetari Devi and Munna Singh got injury. Tetari Devi got grievous injury and Munna Singh got fire-arm injury. Learned counsel for the informant however, opposed the prayer for anticipatory bail of the petitioners, but could not be able to point out any specific allegation of assault against petitioners' no. 2 to 7. The petitioner no.
1 Ram Pravesh Singh is alleged to have assaulted Birendra Singh and Bhaiya Ram Singh, but the injuries they sustained are simple in nature. Considering the facts aforesaid, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Surypura P.S. Case No.
