The petitioner apprehends his arrest in connection with Bhabua Complaint Case No.600 of 2016 registered under Section 406 of the Indian Penal Code.
Allegation, against the petitioner is that he came to the house of the complainant and purchased paddy worth Rs. 10, 72, 980/-, but he paid only Rs. 2,50,000/- and later on, not making payment of rest amount.
The learned counsel appearing on behalf of the petitioners submitted that the payments were made in cash and nothing is due to be paid. Moreover, it is not a case of entrustment and misappropriation.
Considering the aforesaid facts and circumstances and as the case primarily appears of civil nature, so in the event of arrest or surrender in the court below within a period of four weeks from today, let the petitioner, namely, Sitaram Sah be
Patna High Court Cr.Misc. No.5393 of 2017 (2) dt.06-02-2017 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Kaimur at Bhabua, in connection with Complaint Case No. 600 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
