JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was earlier on bail and it is submitted on behalf of petitioner that the petitioner was charged for the offence punishable under Section-307/34 & other minor sections of the Indian Penal Code in the year 2009 and, after that, he appeared before the trial court, in person for near about one year. It is further submitted that in between the said period, not a single prosecution witness was examined and, after that, the petitioner, having entrusted his case to advocate's clerk, went outside the state in connection with his livelihood and pairvikar of the petitioner made pairvi since the year, 2010 but on 30-05-2012, the bail bond of the petitioner was cancelled. No.27694 of 2016 (3) dt.22-07-2016 2/2 behalf of the petitioner that when the petitioner returned to his home, he came to know about cancellation of bail and he was about to surrender before the court but unfortunately, he was caught by the police and was remanded by the court below on 0106-2016 and since then, he is languishing in jail custody. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bihta P.S. Case No. 282 of 2006 corresponding to Sessions Trial No. 137 of 2007 to the satisfaction of learned Assistant Sessions Judge-Ist, Danapur, Patna. (Hemant Kumar Srivastava, J) A.K.V./- U T
