====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 08-10-2018 Heard Sri Binod Kumar, learned counsel for the petitioner and Mr. Md. Ansarul Haque, learned Addl. Public Prosecutor.

The sole petitioner, having clean antecedent, which fact has been stated in paragraph-3 of the petition, apprehending his arrest in Khagaria P.S. Case No. 42 of 2018 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the presence case. He further submits that almost all the family members of the petitioner have been arrayed as accused in the present case. He submits that father of the petitioner was already arrested.

No.56548 of 2018(3) dt.08-10-2018 2/2 Considering the facts and circumstances as well as the fact that the petitioner is having clean antecedent, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Yashwant Jha be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-1st-cum-Special Judge, Khagaria in connection with Khagaria P.S.Case No. 42 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
