Petitioner seeks bail in Sessions Trial No. 458 of 2018 arising out of Ekchari P.S. Case No. 06 of 2018 registered for the offence punishable under Sections 493, 498A, 376, 504/34 of the Indian Penal Code and Section 3⁄4 of D.P. Act. Allegation against the petitioner is of developing physical relation with the Informant on the promise of marriage. It has been submitted on behalf of the petitioner that there is delay of thee days in lodging the FIR. It has been submitted on behalf of the petitioner that there was love affair between the petitioner and the Informant. Petitioner has got no criminal antecedent and is in custody since 18.03.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon
Patna High Court Cr.Misc. No.58823 of 2018(3) dt.30-10-2018 2/2 furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st, Bhagalpur, in connection with Sessions Trial No. 458 of 2018 arising out of Ekchari P.S. Case No. 06 of 2018, with following conditions:-
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
