JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-11-2018 The petitioner seeks regular bail in connection with Buniyadganj P.S. Case No. 73/18, registered for offences punishable under Section 302, 201 and 34 of the Indian Penal Code.
Prosecution story is that son of the informant was traceless and later on his dead body was recovered and during investigation it came to light that the petitioner had illicit relationship with the deceased and she called the deceased on phone and others killed the son of the informant. It has been submitted on behalf of the petitioner that she has falsely been made accused in this case and except her own confession, there is nothing against her and further there is no allegation against her that she killed the deceased rather
Patna High Court Cr.Misc. No.55969 of 2018(3) dt.02-11-2018 2/3 the only allegation against her that she called the deceased. Further she is a lady and has been in judicial custody since 24.04.2018.

Having heard both sides, in view of the fact that petitioner's name transpired on this case only on the basis of confessional statement of co-accused and except that there is nothing against the petitioner, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five) with two sureties of the like amount each to the satisfaction of learned ACJM-XI, Gaya, in connection with Buniyadganj P.S. Case No. 73/18, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself

No.55969 of 2018(3) dt.02-11-2018 3/3 available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
