JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 366A and 354B of the Indian Penal Code and section 8 of Protection of Children from sexual offences Act.
It is alleged that the informant went to purchase something from the grocery shop of the petitioner when the petitioner outraged the modesty of the informant by molesting her and tore the clothes when alarm was raised the petitioner after closing the shop fled away.
It is submitted by the learned counsel for the petitioner that for the petty dispute the accusation has been levelled and informant has retracted from the initial version and has filed a
Patna High Court Cr.Misc. No.22856 of 2015 (2) dt.22-05-2015 2/2 petition to that effect before the learned court below. The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Nawada Sadar Mahila P.S. Case No. 15 of 2015 pending in the court of learned ADJ Ist, Nawada. This application is disposed of with the aforesaid observation/direction.
