JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-07-2015 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel appearing for the informant.

The petitioner is not named in the first information report but in the first information report, the wife of deceased disclosed this fact that five days prior to the alleged occurrence, a Panchayati was held between the petitioner and one, Pappu Yadav and the deceased being Mukhiya had taken active part in the aforesaid Panchayati. In course of investigation, some witnesses claimed that they had seen the petitioner, following the deceased and after the alleged occurrence, the petitioner was seen fleeing from the place of occurrence. Furthermore,

No.22887 of 2015 (2) dt.07-07-2015 2/2 some witnesses stated that before death, the deceased had disclosed the name of the petitioner as assailant but it is surprising enough that the aforesaid fact has not been mentioned in the written report of the informant. Considering the facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chhatapur P.S. Case No. 29 of 2015 to the satisfaction of Learned Sub Divisional Judicial Magistrate, Supaul.
