Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with Dariyapur P.S. Case No. 211 of 2020, registered for the offences punishable under Sections 341, 347, 504, 307, 323, 324, 325, 379, 506/34 of the Indian Penal Code read with Section 27 of the Arms Act.

As per allegation, the accused persons named in the FIR abused the informant and his family members. At the order

Patna High Court CR. MISC. No.68103 of 2021(2) dt.26-07-2022 2/3 of petitioner No. 1, Guriya Devi, co-accused Lalan Kumar Pandey fired shot but the informant escaped. Thereafter, his daughter Kanchan Kumari, petitioner No. 2, assaulted the informant with iron rod.

Learned counsel for the petitioners has submitted that both the petitioners are ladies. They are mother and daughter having no criminal antecedent. He has also submitted that as a matter of fact the informant and his family members used to disconnect the electricity connection of the villagers and after receiving ransom they used to connect the electricity. Informant and his family members badly assaulted the petitioner No. 1 and her family member and made them injured and in this respect petitioner No. 1 lodged Dariyapur P.S. Case No. 191 of 2020. on the other hand, learned Addl.P.P., Sri Shailendra Kumar opposed the prayer for bail.

Considering the facts that the petitioners are ladies having no criminal antecedent, let them, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-13, Saran at Chapra in connection with Dariyapur P.S. Case No. 211 of 2020,

Patna High Court CR. MISC. No.68103 of 2021(2) dt.26-07-2022 3/3 subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
