The petitioner seeks bail in Supplementary Banmankhi P.S. Case No. 71 of 2002 instituted for the offence under Sections 147, 148, 341, 447, 379 and 364 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is named in the written report, but his father name is not mentioned. There is general and omnibus allegation against petitioner and other accused persons that they have kidnapped brother of the informant Haribol Mandal. Counsel for the petitioner further submits that brother of the informant has appeared in the court with regard to trial of other accused persons and he has not supported the case. Thereafter, all the
Patna High Court Cr.Misc. No.58174 of 2018(3) dt.29-11-2018 2/2 accused persons have been acquitted by the court below. Petitioner is said to be in custody since 3.6.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Supplementary Banmankhi P.S.
