The petitioner seeks bail in connection with Amba P. S. Case No.148 of 2021, instituted for the offences under Section 30(a) of the Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 20.09.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 660 litre of liquor from the Swift Dzire car and the petitioner was arrested from the car while one of the accused fled.

The learned counsel for the petitioner submits that petitioner was the driver of the vehicle and as such, was not

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Aurangabad in connection with Amba P. S. Case No.148 of 2021.

The application stands allowed.
