The petitioner is apprehending his arrest in connection with Basopatti P.S.Case No.58 of 2016 registered for offences punishable under Sections341, 323, 379, 504 and 34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act. It is submitted on behalf of the petitioner that the occurrence is under Section 498A of the Indian Penal Code and the petitioner is husband. It is submitted on behalf of the petitioner that he is ready to keep his wife with all dignity and care and learned counsel for the Opposite Party No.2 has submitted that O.P.No.2 is mother of the wife of the petitioner and she has no objection.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the court below on 28th of April, 2017 and on that day wife of the petitioner shall also be present in the court below and the Opposite Party No.2 undertakes to get his daughter appeared in the learned court below on that date. If the petitioner is ready to keep his wife with all dignity and care, he will be released on provisional bail for the period of six months and during that period, he will watch the conduct of the parties and also call them on a fixed date and once being satisfied with the conduct of the parties, he will confirm the bail bond of the petitioner, otherwise, he may pass any order or orders as he deems fit and proper.
With the aforesaid observation, this application is disposed of.
