Petitioner seeks bail in Charpokhari P.S. Case No. 84 of 2017 instituted for the offence under Section(s) 394 Indian Penal Code.
Counsel for the petitioner submits that he is not named in the First Information Report. The name of this petitioner has come in the confessional statement of Baja @ Kush Kumar.
The informant has alleged in the written report that his Hero Honda motorcycle Passion Pro bearing Registration No. BR-03J-0167 has been snatched.
It is alleged that one Pulser motorcycle has been recovered from possession of this petitioner bearing
Patna High Court Cr.Misc. No.61702 of 2018(3) dt.21-12-2018 2/2 Registration No. BR-03M-4066, which is mentioned in para 59 of case dairy. The aforesaid Pulser Motorcycle belongs to the petitioner.
Petitioner is said to be in custody since 13.07.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, II, Bhojpur at Ara, in connection with Charpokhari P.S. Case No. 84 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
